Mountains and Outdoors is a tricky domain to be in and any outdoor activity is as much the travelers’ responsibility as it is the organization’s. We hope to have excellent communication, understanding and complete transparency with our clients in this regard. High Altitude treks especially come with an inherent risk to life and property so it is all the more important to be clear. Once a party (group or individual) confirms a booking with Himalayan Freaks (written as HF hereafter) it has to adhere to the Terms Conditions and Policies as laid out by the organization.

The information about trips given in any brochures, trip notes and pre-departure information are subject to change. It is your responsibility to go through notes and pre-departure information. These can be obtained from HFs website. The information and conditions in the trip notes and pre-departure information are deemed to be part of the contract. Where changes to your trip occur after you have received your final documentation we will, where practical, advise you or your agent of such changes The responsibility of HF is limited to ensure that all the necessary equipment and experienced guides are provided for the tour and that the safest routes are the chosen ones. HF does not accept any responsibility for delays or compensation and loss of enjoyment resulting from circumstances beyond its control.
Acceptance of your booking will be confirmed in writing to you and a contract becomes binding on the date shown on your confirmation letter or email.
For bookings made within 15 days prior to departure HF reserves the right to charge a late booking fee. It is not possible to accept late bookings on some trips.
The price of trek packages depends on when the brochures and website were updated. HF reserves the right to adjust prices whether or not you have made full payment. HF will do everything within its control not to adjust prices and will only adjust or amend prices in the unfortunate event of increased exchange rates The booking and payment options are available on the website. DOCUMENTS TO BE SUBMITTED
BASIC ID PROOF – It has to have full residential address like Aadhaar and Driver’s License and Passport
Medical Certificate: The party has to produce a recent (not more than one month old) Medical Certificate signed by an MBBS doctor certifying that the person is fit for the trek. Failure on producing the certificate will deprive on from participating in the event.
NOC: Participants will also have to fill a No Objection Certificate during registration stating that they understand the endeavor they are about to undertake and the company’s role in it as well as their own The booking of a particular trek will be secured, only upon receipt of the above documents along with the confirmation from our bank that the due amount has been transferred or with the signed credit card charge authorization. Following this a confirmation email will be sent to you by us. HF reserves the right to decline, or accept, any individual as a trip member for any reason whatsoever
2. TRIP CANCELLATION AND REFUNDS
● Make sure any cancellation is done no later than 30 days before the tour departure date.
● Cancellation on any day before 1 month to the start of the trek: 50% refund of the booking amount
● In case of Cancellation less than 1 month to the start of the trek: You can transfer your trek (same trek, same batch) to someone else. No cash refund. Please Note: The person to whom you transfer the seat should be able to satisfy all the mandatory requirements laid out by HF (medical and otherwise. Change of trek batch is dependent on the availability of seats in the batch.
● Any cancellations have to be received in writing i.e. through email. No refund will be made to clients who drop out from the journey regardless of whatever portions remain unused in the itinerary.
● Alterations by the Client Any sudden change from the clients’ end in terms of date, choice of trek packages, number of participants, etc will be regarded as a cancellation
● In addition to this there will not be any refund if one is dropping out of the program voluntarily/involuntarily for any unused services like transportation, food, accommodation, sightseeing, meals or any unutilized services.
HF advises clients to get covered by a personal accident insurance, which has to include appropriate coverage for medical expenses and cost of repatriation, including helicopter rescue and air ambulance.
HF reserves the right to take photographs of participants of a trek that may be used for promotional purposes. HF advises participants who wish to not be photographed to identify themselves to the tour leader in the beginning itself. Also note that many pictures that have been put on the website are promotional. A lot of images are solely for marketing purposes and don’t guarantee that those very landscape will be visible.
5. ITINERARY AND COST ALTERATION
In the interest of the participants the company reserves the right to make a change or cancel any trek due to weather conditions, safety reasons, low physical level, low participation (if a minimum participation level is required for a program to run) or any other factor beyond our control -force majeure (natural disasters, inclement weather, strikes etc). Such changes will always be at the discretion of the company’s group leader and the Company. HF also reserves the right to revise the rates and charges of services for other reasons like Government acts and policies
All extra expenses like side excursions, extra transfers, extra nights etc. have to be borne on the spot by the Client. These are expenses requested by the Client during/after the program that had not been originally requested. Sack off loading will be charged extra. In case you feel that you can’t carry your sag, then INR 300 per day per sack will be charged. Each sack should not weight more than 10 kg. Package cost does not include your transport till base camp. Transport will be provided by company on sharing basis (charges extra).
6. PERSONAL BELONGING
HF will not be responsible for any loss or damage to your personal possessions during the journey. Any loss or damage of your personal stuff, clothes, equipment or money is not to be borne by the company. You will hand over your personal belongings to porters and mules at your own risk. In case of any accident or event, any damage or loss of your stuff will not be borne by us. In case of flight cancellation pre-tour/post-tour, you need to meet your accommodation and food costs yourself.
7.BEHAVIOR ON TREK
How the clients conduct themselves throughout the journey is of utmost importance to HF By accepting the terms and conditions as laid out by the company the Client agrees to accepting the authority and decisions of the Company’s employees, trek leaders and agents whilst on the treks with the Company. If the company employs decide that the health or action of a participant at any time before or after departure appears likely to endanger the smooth execution of a program, then participants may be excluded from all or part of the trip/ program without refund or compensation. In case of health/medical problem, the Company may make such arrangements, as it seems fit and recover the costs thereof from the participant. HF shall cease to have responsibility to/ for participants in case they commit an illegal act. The participant may be excluded from the trek. Behaviour that causes danger to other participants, leading to loss of property or distress to other members will not be tolerated. In case of any misconduct on the group’s part, the trip will be terminated and no refund will be done for any unused services from that point of time. The final decision in such a situation will be taken solely by the group leader.

This clause states that you acknowledge by accepting the terms and conditions of HF that there is inherent risks in travel and adventure activity beyond the accepted safety of life at home.
There is no inducement or coercion to go on the adventure trip, but entirely of your own free will.
You fully understand what you are undertaking by taking part in an adventure activity.
You further agree that in case of any medical emergency HF can at any cost, arrange medical treatment and emergency evacuation service, as they deem essential for your safety.
An alternative trek of a similar standard, cost and nature will be referred to client in case HF cancels a trek due to unforeseen circumstances like war, natural disasters, conflict or unfavorable climate.
But remember, any other expenses incurred by you because of this booking are entirely your responsibility.
By ticking or signing the acceptance and acknowledgement of understanding HF terms and conditions, you confirm that you accept liability for loss, injury, death, or damage, however caused which you may directly or indirectly suffer in connection with your trip within the extent permitted by law. By accepting HF terms and conditions you also waiver any and all claims you may now and in the future have against, and release from all liability HF, its service agents, independent contractors, employees, guides, porters and agents.
